Adoption Visa (Subclass 102)

The Adoption  (Subclass 102 )  is a visa that lets children adopted outside  Australia, move to Australia to live with their adoptive parents permanently.

Successful applicants will be entitled to stay in Australia permanently. They will be able to study and access Medicare. When eligible they may be able to apply for Australian Citizenship.

General eligibility criteria

To be eligible, the child must;

  • be outside of Australia to apply
  • be or have been in the process of being adopted through intercountry adoption or arrangement with the involvement of an Australian state or territory central authority dependent on a parent who is Australian Citizen / Permanent Resident or eligible New Zealand, citizen
  • have been or be in the process of being adopted through an intercountry adoption between 2 countries (other than Australia) that are parties to the Hague Convention on the Protection of Children and Cooperation in Respect of Intercountry Adoption (the Hague Adoption Convention), or
  • if no Australian state or territory central authority was involved, through an expatriate adoption by an Australian citizen, an eligible New Zealand citizen or the holder of an Australian permanent visa who has been living outside Australia for more than 12 months before the visa application is lodged
  • They can be their parent’s biological child, adopted child or stepchild
  • Sponsor must be an eligible adoptive parent or prospective adopted parent
  • The child must be under 18 years old
  • The child must meet Australian health and character requirements
  • The application must be lodged outside of Australia
